Shuttered firms put properties in play Premium Content

NEW YORK -- When a broker switches firms, mailing out glossy announcement cards is the easy part. What's not so simple is wresting listings away from the old firm to bring them to the new one. The armor-plated contracts that govern exclusive listings threaten sellers with punitive fees or lawsuits if they try to pick up and follow a relocating broker.

But the recent shuttering of several New York firms has shaken loose hundreds of listings, in a whirlwind that few have seen in years, brokers say.  more...

Sonya Becknel drew a flood zone map the size of her desk before buying a home in Chalmette in St. Bernard Parish, southeast of New Orleans.

St. Bernard was one of the hardest-hit areas of New Orleans after Katrina struck four years ago. The parish is rebounding, even though some returning residents did not receive restitution for their flooded homes after the storm.

Seller disclosure: police calls included

DEAR BERNICE: We live in California and are currently in a lawsuit against the sellers of our home two years after the sale. In the winter of 2007 our agent told us that he knew some folks that had been thinking about selling their home for a while. We saw the house and loved it because it was in a very desirable area, and we made an offer.

Almost immediately after moving in, we discovered that the tenants renting the house across the street were a group of six "20-somethings." They were some of the hardiest partiers we'd ever experienced, throwing parties three to four times per week. A party starting at 2 a.m. on a Tuesday was common.  more...

MLSCloud growing fast

By Inman News, Thursday, September 3, 2009. MLSCloud.com, an interactive map-based directory of Realtor associations and multiple listing services, claims to represent more than half a million brokers and agents less than four months after its launch.

The collaborative network of public MLS Web sites was launched in May by the Houston Association of Realtors (HAR), Metropolitan Regional Information Systems (MRIS), and MLSListings.com. The site, which displays a Google-powered map that provides links to member Web sites, counts 52 Realtor associations and MLSs as members.  more...

Rent-to-own becomes raw deal

Q: We are renting a single-family home that we thought we might want to buy. When we signed the lease two years ago, we paid the landlord several thousand dollars for an option to purchase the home at a commercially reasonable price. Last month, the landlord put the home on the market, and we jumped at the chance to buy it. But now we've learned, through the disclosures, that it has significant structural damage that wasn't evident all the while we lived here. We're not going to buy it, but we want to know -- can we get that option fee back? Had we known then what we know now, we wouldn't have paid for the option. --Tom and Mary Z.

A: Residential property sellers and their brokers are subject to numerous inspection and disclosure obligations regarding the physical condition of the property, about everything from the presence of lead paint or asbestos to "natural hazards" of the area (such as being in a special flood zone), the age of the roof, and even the quality of the home's insulation.  more...

An open letter to new agents

I don't have any numbers but historically, when unemployment has risen more people start their own businesses, and some go into real estate sales. It doesn't cost much to get started and requires very little education.

Lately, I have run into a few people who have just joined us and have received some calls from others who would like to become Realtors.

We all have to start someplace and I was once a new agent. In fact, to some I still am, even though I have been in the business for less than a decade. It takes some experience to do a good job representing clients. When you don't let me know that you are new, I can't help you.  more...

My perfect escrow

As you know by now, I'm on a mission to bust the myth that real estate agents and their preferred service providers are sitting around in back rooms rubbing their hands together and cackling with sinister glee as they formulate evil plots to boost their own profits at their buyer clients' expense.

In reality, what most agents want is for their buyers to get what the buyer wants -- a home that is a good value, in good shape (or in the shape the buyer believes it's in), with a smooth buying process and on-time closing.

When it comes to escrow companies, these service providers have a huge degree of influence on the buyer's experience and the outcome of a transaction.  more...
