Court denies lawyer fees in real estate case

A California appellate court reversed a lower court's ruling and recognized a California Association of Realtors mediation clause related to attorney fees in a real estate dispute.

The broker who filed the lawsuit, Jay Lange, charged fraud, negligence, failure to disclose and suppression in a property he had purchased for himself. He filed the lawsuit in 2004 against Roxanne Schilling, a real estate agent, and her company, Segerstrom Real Estate Inc. The complaint centered on construction problems with the property and the level of the nearby lake.  more...

For-sale inventory, days on market higher in June Premium Content

Listings inventories increased in 17 of 26 markets tracked by Altos Research & Real IQ during June, while average days on market was up in 19 of 26 markets, the companies said.

Los Angeles and San Diego saw the largest jumps in inventory -- 8.7 percent and 6.1 percent,  respectively -- and Miami had the slowest rate of turnover with an average of 154 days on market.  more...

Fed to tighten rules for lenders, banks Premium Content

Proposed changes for Truth in Lending
The Federal Reserve Board will issue new rules for mortgage lenders next week that could require mortgage brokers obtain written agreements from borrowers in order to collect yield spread premiums, and prohibit the coercion of appraisers to inflate property valuations. Changes to Regulation Z, which spells out the Fed's implementation of the Truth in Lending Act, were proposed in December (see story).  more...

Localism reaches for broader user-generated content Premium Content

Localism, a neighborhood-focused Web site launched in beta last year by the ActiveRain online real estate network, has retooled with a new design and a plan to join together its real estate members with the general public in defining neighborhood areas and creating content around them.

Localism.com, which draws content from ActiveRain's user base of roughly 97,000 members, works on the micro and macro scale in allowing users to search for information categorized at the state, county, city, neighborhood and community levels.  more...
