As a lawyer, I focus much of my work on e-commerce, databases, web branding issues, and rule-making for online communities. As a consultant, I provide strategy, operations, and marketing consulting in the residential real estate vertical (particularly to MLSs, associations, and brokers). The majority of my clients are real estate multiple listing services (MLSs), REALTOR associations (local and state), and large real estate brokerage firms. I advise them regarding policies, business strategies, licensing agreements, agency laws, and more.

    I'm curious: If the selling broker is really working as the buyer's AGENT, wouldn't it be a violation of her ethical and agency obligations to show her buyer homes based on which ones will result in the biggest paycheck for her? Would she have to disclose to the buyer what her compensation is on the high-value listings? Just wondering... -Brian

    This is a great, simple summary of this issue. I was hoping for Jim to go one step further, though: If, as a broker, you think you are going to have a better shot at a 'hogger' by advising your seller to withhold her listing from MLS, you are treading on thin ice from the perspective of your agency duties. As as seller, if your broker is advising you keep your listing secret, I'd review their rationale very carefully. (I'm not saying it's wrong in every case - just advising heightened critical thinking in that event.) -Brian
