Dual Agency is a very tough issue. Since there is no NAR standard for agency practice, each state just struggles through variations on Dual Agency, Sub-agency, Tranasation brokerage, Designated brokerage and many variations in between. Perhaps it is time to consider a national standard for agency practice that at least as REALTORS, we would be able to incorporate in to our standards of practice. Canada is farther ahead on a national standard that the USA is because their national association is the governing body in many provinces. Their model law has been in progress for 6 or 7 years and is a common ARELLO discussion subject. As our market consolidates, and many boards are being combined in to regional MLS ( in California a statewide MLS ), our laws and practices need to be more standarized. Who better than NAR to start moving on this issue before the various state legislatures mess it up more. Over half of the legislators in most states are lawyers. Lawyers get many paychecks based on unclear laws that need interprestation in court. The more unclear a law is, the better it is at feeding time for the lawyers. Rather than whining about unfair dual agency issues, let's look at the bigger picture, where will our industry be in 10 or 20 years and start anticipating change before it is jammed down our throats. www.SellDirt.com Tracy S. I pray that Richard Gaylord, NAR President is correct with his predictions about liquidity in the markets. It is not just the housing market that is being crunched in Hawaii. Visitor arrivals are off over 30% in many areas as everybody has been afraid the world is ending. Talk about a great time for a Hawaii vacation, the beaches are uncrowded, traffic is light, you can get a reservation easily to the best restaurants, and hotels are creating incredible vacation packages with airlines. What a great time for real estate bargain hunters to come hunt and gather. Great deals abound in the Islands. Bring some of that cash you just pulled out of your banks over the past few weeks and put it in some great Hawaii real estate, rather than rolling your dice in the stock market. Aloha from Maui ! Hawaii is watching and waiting for California's success in the state-wide MLS. We anticipate doing the same in the near future. With only 4 MLS systems in our state, it would seem like a no brainer. The good old fashioned provincial attitute of not sharing inventory is being overwhelmed by the internet. With almost 30 years in the business, I am qualified to be a dinosaur, however, my 25 year son and business partner, Jeremy, keeps pushing me along. In this market, it is change or die. I am not ready to be a fossil yet although I may resemble one. Hooray for California ! Better we take control of our destiny before some 3rd party private company does. Tracy S.
