Final rules for compensating mortgage loan originators issued by the Consumer Financial Protection Bureau after taking over responsibility for implementing the Truth in Lending Act pose “significant challenges” to the mortgage lending industry’s compliance efforts, according to an analysis by the law firm K&L Gates. The CFPB dropped an “extreme” proposal that would have required lenders to offer no-point, no-fee mortgages, but solidified existing prohibitions on compensating originators based on loan terms or the source of compensation.
