The CRMLS vs. Compass lawsuit has turned a years-long debate over private listings into a federal court fight, and the outcome could change how every agent accesses listing data. Is the MLS a broker cooperative, or a public marketplace for listing data? And can it survive trying to be both?
On this episode of Real Estate Insiders Unfiltered, James Dwiggins and Keith Robinson bring back Rob Hahn, the Notorious R.O.B., and Greg Robertson, co-founder of W+R Studios and Vendor Alley, to break down the escalating fight between Compass and the MLS.
CRMLS, the country’s largest MLS, filed a preemptive federal lawsuit after Compass demanded MLSs stop fining agents for publicly marketing office-exclusive listings.
Hahn walks through the legal theory behind Compass’s demands, including NAR’s 14 Points from 1971 and why they still matter. Robertson shares a firsthand account of Robert Reffkin’s tense appearance at the Council of Multiple Listing Services conference, which came just an hour after CRMLS announced its lawsuit.
The group also debates who owns listing data, whether the fight is really about agent recruiting and what happens to agents if big brokerages stop sharing listings.
It gets heated, but the hosts and guests also find common ground. Agents’ value has never come from listing data, and the industry risks losing consumer trust if this fight drags on.
Editor’s note: Since this was recorded, Compass has filed a lawsuit against CRMLS.
Highlights from the CRMLS vs. Compass debate
In this episode, you’ll learn:
- Why CRMLS filed a preemptive lawsuit against Compass
- How NAR’s 14 Points from 1971 factor into the case
- What happened when Robert Reffkin took the stage at CMLS
- Why agent recruiting may be the real driver behind private listings
- Who actually owns listing data
Hahn argues the MLS can’t be both a broker cooperative and a public data and marketing platform. In his view, it has to choose. Dwiggins and Robertson push back, pointing to consumer expectations for transparency and the damage that negative headlines are doing to the industry. Robinson calls it greed on both sides and asks why the industry can’t find a revenue-sharing model instead of blowing up the system.
The group also explores what happens if large brokerages stop sharing listings with one another. They look to commercial real estate as a possible preview and consider what that future would mean for comps, appraisals and independent brokerages.
Through all the disagreement, they land on one point: An agent’s value proposition was never the listing data. It’s guiding clients through one of the most complex and emotional transactions of their lives.
