Who will emerge from the turn?
By Matt Carter, Tuesday, November 25, 2008.With LandAmerica no longer able to count on a merger with Fidelity to resolve its issues with creditors, we may be headed for the biggest shakeup in the title insurance industry since Mercury Cos. shut down operations in five states and sold its remaining title and escrow operations in Colorado to Fidelity (see story).
LandAmerica says its underwriting subsidiaries are well funded to pay claims, but the question has now become how the company funds ongoing operations. Some analysts who follow LandAmerica reportedly see bankruptcy as an option. LandAmerica's already closed down its 1031 exchange company (see story).
LandAmerica's got several hundred subsidiaries or companies it holds an interest in. We'd like to hear from Inman News readers if you are with one of those subsidiaries or do business with them on what happens next.
And more broadly, what do readers think the broader implications are for the title insurance industry? A Fidelity-LandAmerica merger would have put about 75 percent of the business in the hands of just two companies: Fidelity/LandAmerica and First American.
Could we still be looking at that kind of consolidation? Would that be a problem for you, or do you see any silver lining?
UPDATE: Fidelity is now looking to pick up LandAmerica's title insurance underwriting subsidiaires in bankruptcy court. If the deal goes through, Fidelity and First American would control about 75 percent of the title insurance business (see story).

It seems clear, by the number of subsidiary holdings, LandAmerica chose a business model that emphasized leveraged growth. This is simply another example of gluttony gone bad.
I hope they do not find a bailout option and suffer the consequences of poor business management. What ever happened to sustainable growth policy combined with careful cash management? Can you imagine how viable they would be today if they had been prudent verses reckless during the crazies of 2003-2006?

This may be off topic, but I can't say that I would be sad if the LandAm direct operations in our little town went away. They have managed to become the "Walmart" of the county, when asked why agents use them the response is well they brought us cookies, they order all of my inspections and pay they for my web site etc.... Violations, I think so. Meanwhile the local companies, who keep the money they make in the county are suffering. I received a call on Wednesday before Thanksgiving, a buyer who was scheduled to close with LandAm at 10:30 that day, they received word at 10:15 that their lender would not accept the CPL from LandAm. Could we get this done in a hurry. My response, of course we can. The office was closed on Friday, but we had the new title commitment out on Monday and we closed on Wednesday. To my surprise both the buyer and seller were astonished to realize that they had both saved $100.00 by switching to us. I am not a mean person, but if the only business I get is because LandAm was greedy and is now paying for it. Yipee.
PS I used to work for Lawyer's Title back in the 90's I know how they operate.

UPDATE - Dec 19 (Reuters) - Fidelity National Financial Inc (FNF.N) said it received approval under the Hart Scott Rodino Act for the purchase of two underwriting units from bankrupt title insurer, LandAmerica Financial Group Inc.
Fidelity National had agreed to acquire LandAmerica's Commonwealth Land Title Insurance Co and Lawyers Title Insurance Corp for about $282 million.
Fidelity National expects to close the transaction on or before Dec. 22.

I don't like the the size and market share of this firm it looks done to me. These large market share companies have lead us to the "too big to fail" bail out mania we are in today.

AS Land America already mentioned its underwriting subsidiaries are well funded to pay claims, but what about the how the company funds ongoing with operations. As usual analysts who follow LandAmerica reportedly having only one option bankruptcy as an option. hope it will not affect to any finance market badly.

On December 22, 2008, Fidelity National Financial, Inc. directly and through its underwriting subsidiaries acquired from LandAmerica Financial Group, Inc. the following companies:
* Lawyers Title Insurance Corporation and all if its subsidiaries
* Commonwealth Land Title Insurance Company and all of its subsidiaries (including LandAmerica NJ Title Insurance Company)
* United Capital Title Insurance Company

Training camp is a relentlessly optimistic time, when everybody gets back in football mode, we all expect our exams preparation teams to reach the Super Bowl and we think we have a clue about what will happen with our fantasy clubs 640-863 exam.
It also is a time for education as we try to read too much into snippets of preseason playing time and gauge how well new players will fare in new places 350-030 exam. Even with a bunch of practices throughout spring and summer, training camp fills an important void. And for some important situations, we can get first impressions about how 2009 will play out.

I'm not to happy with these bigger companies, and I use a local funded company for all of my closings. They contribute to our community, and I contribute to them which is the only way I do business. These big companies that are "too big to fail" should just fail, and let the little guys pick up the slack. We would get better customer service, and the money would be spread out through the middle class more. Which is a good thing despite what the rich people say.
